Course objectives
The aim of subject: Instruction in the subject shall focus on presentation of relevant changes provided for by the Lisbon Treaty, not only in the delimitation of competences between EU and its Member States, but in the institutional architecture of the Union as well. The aim of the subject is to outline the complex view of functioning of the EU bodies in the legislative procedure, taking into account the national implementation of the Union rules too. Furthermore, the changes in the procedure at the Court of Justice of the EU will be presented in detail. Reflecting the role of Member States as the original sources of powers delegated to the Union, the new categories of competences shall be presented, including the application of principles of subsidiarity and proporcionality.

    1) Struktura práva EU
    a) Primární právo EU a otázka delegace pravomocí
    b) Sekundární právo EU - struktura a vlastnosti

    2) Legislativní proces v EU a jeho aktéři
    a) Iniciace, projednávání, schvalování a implementace evropského sekundárního práva
    b) Role členských států v evropském legislativním procesu

    3) Postavení a pravomoci Soudního dvora EU
